TERMS OF SERVICE

Reform Studio Whistler Studio Policies

1. Booking & Account Creation

All classes must be booked through Mariana Tek. Clients must maintain accurate account information to the best of their ability.

2. Memberships & Class Packs

Memberships

  • Monthly memberships auto-renew.

  • Founding Membership rates are lifetime-locked unless cancelled.
    If cancelled, members forfeit locked rate and must rejoin at current pricing.

Class Packs

  • Class packs expire as stated at purchase.

  • Unused classes are non-refundable and non-transferable.

  • Extensions are at Reform Studio Whistler discretion only.

3. Cancellation & No-Show Policy

  • Cancellations must occur at least 8 hours before class.

  • Late cancellations incur a fee.
    No-shows forfeit the class and may incur penalty fees.

  • Policies apply to memberships and class packs.

4. Payment Terms

  • All payments are processed through Mariana Tek via Stripe.

  • Clients authorize recurring charges for auto-renew memberships.

  • Declined payments may result in suspension.

5. Refund Policy

All sales are final. Refunds are issued only in exceptional circumstances at management discretion.

6. Studio Conduct

Clients must:

  • Arrive on time (late entry may be denied).

  • Follow instructor guidance.

  • Wear appropriate attire.

  • Respect equipment and other clients.

The Studio reserves the right to refuse service.

7. Independent Contractors

Instructors are independent contractors. Participation does not create an employment relationship between clients and instructors. All instructors must have public liability insurance.

8. Limitation of Liability

The Studio is not liable for indirect, incidental, or consequential damages arising from participation.

9. Governing Law

These Terms are governed by the laws of British Columbia.

10. Amendments

Reform Studio Whistler reserves the right to update these Terms at any time.

CLIENT LIABILITY WAIVER & TERMS OF SERVICE

(Reform Studio Whistler; Whistler, British Columbia)

ASSUMPTION OF RISK, WAIVER OF LIABILITY & INDEMNIFICATION AGREEMENT

By participating in classes, private sessions, workshops, events, or using equipment at Reform Whistler (the “Studio”), I acknowledge and agree to the following:

1. Acknowledgment of Risk

I understand that Pilates, fitness training, and use of studio equipment, including but not limited to reformers and all associated entities (springs, resistance straps, box, platforms, weights, props including balls and bands, and other parts of the apparatus) involve inherent risks.

These risks may include, but are not limited to: muscle strain or tears, sprains, joint injury, slips or falls, equipment malfunction, dizziness or fainting, and/or aggravation of pre-existing conditions.

I voluntarily assume full responsibility for any risk of injury, loss, or damage arising from participation.

2. Medical Responsibility

I confirm that:

  • I am physically capable of participating.

  • I have consulted a physician if I have any medical concerns.

  • I will inform the instructor of any injuries, limitations, or medical conditions before class.

I acknowledge that Reform Studio Whistler and its instructors do not provide medical advice nor care.

3. Pregnancy & Postnatal Participation

I understand that:

  • Prenatal and postnatal exercise carries specific considerations.

  • I am responsible for obtaining medical clearance if necessary.

  • I will inform instructors of pregnancy status or postpartum recovery.

I voluntarily assume all risks associated with prenatal or postnatal participation.

4. Release of Liability

To the fullest extent permitted by the laws of British Columbia, I release, waive, and discharge:

Reform Studio Whistler, its owners, directors, contractors, instructors, employees, agents, and affiliates from any and all claims, demands, damages, actions, or causes of action arising from participation, including negligence.

5. Indemnification

I agree to indemnify and hold harmless Reform Studio Whistler against any claims resulting from my participation or conduct at Reform Studio Whistler.

6. Property & Personal Belongings

Reform Studio Whistler is not responsible for lost, stolen, or damaged personal property.

7. Governing Law

This Agreement shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

8. Acknowledgment

By booking or attending classes via MarianaTek or in person, I acknowledge that I have read, understood, and agree to the waiver provided by Reform Studio Whistler.
